Dienos šviesą išvydo keturių šalių mokslininkų parengtas leidinys „Reglamento Briuselis IIa taikymo vadovas“ lietuvių kalba. Šiame leidinyje, kuris yra dalis teisėjams organizuotų mokymų medžiagos, aptariami klausimai, susiję su santuokos nutraukimu ir tėvų pareigomis bylose, turinčiose tarptautinį elementą.
Leidinyje nagrinėjami įvairūs Europos Tarybos reglamento dėl jurisdikcijos ir teismo sprendimų, susijusių su santuoka ir tėvų pareigomis (kitaip vadinamo Reglamentu „Briuselis IIa“), taikymo aspektai. Pagrindinis dėmesys skiriamas Europos Sąjungos Teisingumo Teismo bei valstybių narių nacionalinių teismų praktikai sprendžiant bylas, kuriose svarbus šio Reglamento taikymas.
Reglamento taikymo vadovas parengtas orientuojantis į tikslinę grupę – nacionalinius teisėjus, neretai susiduriančius su šeimos bylomis, turinčiomis tarptautinį elementą. Tad skaitytojai turėtų rasti nemažai aktualių patarimų ir praktinių pavyzdžių, padėsiančių spręsti tokio tipo bylas, ar atskleidžiančių, kaip į vieną ar kitą klausimą žvelgė kitų ES šalių teisėjai. Prie leidinio rengimo darbų daug prisidėjo ir Lietuvos teisės instituto mokslininkė Agnė Limantė, tad jame gausu ir pavyzdžių iš Lietuvos praktikos.
Šis leidinys buvo parengtas įgyvendinant ES Teisingumo programos lėšomis finansuojamą tarptautinį projektą „ES teisėjų mokymai dėl „Briuselio IIa“ reglamento: nuo pietų iki rytų“ ir nemokamai išplatintas mokymų dalyviams. Tarptautinį projektą 2015–2017 metais Lietuvos teisės institutas įgyvendino kartu su Barselonos universitetu, Milano-Bicocca universitetu ir Rijekos universitetu.

Prepared by four of the country’s researchers, the Handbook on the Application of Brussels IIa Regulation has been published in Lithuanian. This publication, which is part of the material for the training that was organised for judges, discusses questions related to divorce and parental responsibility in cases with an international element.
The publication explores different aspects of application of the Council Regulation concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility (also known as the Brussels IIa Regulation). The main focus is on the practice of the Court of Justice of the European Union and the national courts of the Member States in resolving cases where the application of this Regulation is relevant.
The handbook on the application of the regulation was drawn up for a target group of national judges who often deal with family cases with an international element. Thus, readers should find quite a bit of relevant advice and practical examples which help resolve this type of cases or which reveal how judges from other EU countries look at one issue or another. Dr. Agnė Limantė, a researcher at the Law Institute of Lithuania, contributed significantly to preparation of the publication, and there are plenty of examples from Lithuanian practice.
This publication was prepared as part of an international project “EU Judiciary Training on Brussels IIa Regulation: From South to East” funded by the EU Justice Programme and was distributed free of charge to training participants. The Law Institute of Lithuania implemented the international project in 2015–2017 in conjunction with the University of Barcelona, the University of Milano-Bicocca, and the University of Rijeka.
