LTI mokslininkė apžvelgia knygą apie ES Teisingumo Teismą

Jungtinėje Karalystėje leidžiamas ir aukštą Impact Factor turintis mokslo žurnalas „Journal of Common Market Studies“ paskelbė Lietuvos teisės instituto (LTI) mokslininkės dr. Agnės Limantės parengtą knygos apžvalgą. Mokslininkė apžvelgė Dorte Sindbjergo Martinseno knygą „An Ever More Powerful Court? The Political Constraints of Legal Integration in the European Union“ (liet. „Vis galingesnis teismas? Politiniai teisinės integracijos Europos Sąjungoje apribojimai“).

Mokslininkė pastebi, jog neretai lyg savaime suprantamą tiesą mes priimame teiginį, kad Europos Sąjungos Teisingumo Teismas (ESTT) atlieka itin reikšmingą vaidmenį skatinant Europos integracijos procesą ir turi itin didelę reikšmę ES politikai ir teisės aktams. Tačiau ar iš tiesų šis Teismas toks galingas? Ar jo sprendimai visuomet daro įtaką teisėkūrai? Kaip ir ar visuomet ESTT sprendimai atsispindi antriniuose teisės aktuose? Į šiuos klausimus siekia atsakyti apžvelgiama Dorte Sindbjergo Martinseno knyga.

„Autorius kviečia mus pažvelgti giliau, sudvejoti savo įsitikinimais ir siūlo detaliau panagrinėti ES teisėkūros institucijų ir ESTT sprendimų santykį per konkrečius pavyzdžius“, – rašo LTI mokslininkė apžvalgoje.

Anot mokslininkės, knyga yra įžvalgi ir teoriškai, ir empiriškai. Knygos autorius pasirinko tris sritis, kuriose išsamiai išnagrinėjo ESTT sprendimų ir teisės aktų sąveiką: ES darbo laiko reguliavimą, ES piliečių teises į sveikatos priežiūros paslaugas kitoje ES šalyje ir komandiruotų darbuotojų reglamentavimą. Nuoseklia analize autorius pagrindžia, kad ESTT visgi nėra tokia įtakinga politiką formuojanti institucija, kaip neretai manoma.

The Journal of Common Market Studies, a scientific journal with a high impact factor that is published in the United Kingdom, recently published a book review written by the Law Institute of Lithuania (hereinafter – LIL) researcher dr. Agnė Limantė. The researcher reviewed a book An Ever More Powerful Court? The Political Constraints of Legal Integration in the European Union by Dorte Sindbjerg Martinsen.

The researcher notes that we often take it for granted that the Court of Justice of the European Union (CJEU) plays a very important role in promoting the process of European integration and is of particular importance to EU policies and legislation. But is this Court really that powerful? Do its judgments always impact law-making? Are the judgments of the CJEU always reflected in secondary legislation, and how? These are the questions that were addressed in Dorte Sindbjerg Martinsen’s book.

“The author invites us to take a deeper look and question our convictions; he proposes a more detailed analysis of the relationship between EU legislative bodies and the judgments of the CJEU through concrete examples,” writes the LIL researcher in the review.

According to researcher, the book is insightful both theoretically and empirically. The author of the book chose three areas to examine the interaction between the judgments of the CJEU and EU legislative bodies: EU working time regulation, the rights of EU citizens to healthcare in another EU country, and the regulation of posted workers. Through systematic analysis, the author argues that the CJEU is actually not such an influential policy-making body as is often assumed.
