This week, an expert group headed by Law Institute of Lithuania (LIL) director Dr Jurgita Pau\u017eait\u0117-Kulvinskien\u0117 is working in Ukraine. The working group has proposed innovative solutions for draft legislation on the Ukrainian ombudsman.\u00a0<\/p>\n
In many European countries, the objective of the ombudsman is not only to act as a defender of human rights, but also to promote responsible management skills in public administration. A proposed supplement to the draft legislation on the ombudsman is being prepared in Ukraine which aims to improve the status of the ombudsman. Taking into account the practice of European ombudsman institutions, appointment and dismissal procedures, immunities and performance guarantees are provided for in the proposal.<\/p>\n
Another important new part of the law is the mandate of the ombudsman and improvement of complaints procedures. Headed by the director of the LIL, the working group is proposing to foresee two legal decisions that the ombudsman can take after each individual investigation into a complaint: a recommendation to a public institution or a response\/management act with specific sanctions for the offender (institution, civil servant or official).\u00a0<\/p>\n
The working group is also preparing a new version of the unified Draft Law on Equal Opportunities for Ukraine.<\/p>\n
The project in Ukraine to strengthen the capacity of the ombudsman, under the coordination of the Law Institute of Lithuania, is being implemented by a team of experts from the Seimas Ombudsmen\u2019s Office of the Republic of Lithuania, the Lithuanian Law Institute, the Office of the Equal Opportunities Ombudsperson, the State Data Protection Inspectorate, the Vilnius University Faculty of Law and the Ludwig Boltzmann Institute of Human Rights (Austria). The Central Project Management Agency will ensure the financial and administrative management of the project.<\/p>\n
