Naujausiame Teisės instituto leidinyje mokslininkų komanda peržengia korupcijos viešajame sektoriuje ribas: tiriama korupcijos privačiame sektoriuje problematika

Nors iki šiol korupcija bei kyšininkavimas bendrąja prasme daugeliui asocijuojasi su piktnaudžiavimu valdžios įgaliojimais, korupcija privačiame sektoriuje – taip pat vis daugiau dėmesio šiais laikais sulaukiantis reiškinys. Tačiau korupcijos privačiame sektoriuje sąvokai Lietuvos kontekste būdingas teisinis neapibrėžtumas – ji neatskleidžiama nei nacionaliniuose, nei tarptautiniuose teisės aktuose.

Lietuvos socialinių mokslų centro Teisės instituto mokslininkų dr. Kristinos Ambrazevičiūtės, dr. Eglės Kavoliūnaitės-Ragauskienės bei dr. Petro Ragausko bendradarbiavimo rezultatas – monografija „Korupcija privačiame sektoriuje“, kuria siekiama pateikti apibendrintą korupcijos privačiame sektoriuje problemiškumo įvertinimą Lietuvos kontekste.

Šią monografiją galima pavadinti 2016–2020 m. Instituto mokslininkų vykdytos specialios mokslinių tyrimų programos „Naujas požiūris į korupciją: iššūkiai ir galimybės peržengiant viešojo sektoriaus ribas“ dalies atliktų tyrimų kvintesencija. Leidinio pirmojoje dalyje autoriai formuoja korupcijos privačiame sektoriuje problemą: apibrėžia pačio reiškinio sąvoką ir pateikia santykio su viešojo sektoriaus korupcija vertinimą. Taip pat siekiama ne tik atskirti korupciją privačiame sektoriuje nuo gretutinių reiškinių, kaip antai konkurencijos, lobistinės veiklos bei dovanų teikimo, tačiau ir konkretizuoti keliamas grėsmes ir potencialią žalą. Antroji monografijos dalis skirta išsamiai pagrindinių priemonių, skirtų spręsti korupcijos privačiame sektoriuje problemą Lietuvoje, analizei, apimančiai baudžiamąją teisę, darbo teisę, civilinę teisę ir privataus sektoriaus savireguliaciją.

Although by many, corruption and bribery are still widely associated with abuse of power by government officials, corruption in the private sector is an increasingly relevant phenomenon nowadays as well. However, the concept of corruption in the private sector in the Lithuanian context is characterized by legal uncertainty – it is not disclosed in either national or international legal acts.

The team of Law Institute of the Lithuanian Centre for Social Sciences researchers, consisting of dr. Kristina Ambrazevičiūtė, dr. Eglė Kavoliūnaitė-Ragauskienė and dr. Petras Ragauskas’ presents the result of their most recent collaboration – the new monograph “Corruption in the Private Sector”. The overall objective of the study is to summarize the assessment of the problem of corruption in the private sector in the Lithuanian context.

The publication reflects the quintessence of the research carried out through 2016-2020 by the researchers of the Institute as part of the special research program “A New Approach to Corruption: Challenges and Opportunities Beyond the Public Sector”. In the first part of the study, the authors focus on the issue of corruption in the private sector: the concept of the phenomenon itself is defined and an assessment of the relationship with corruption in the public sector is provided. The monograph also seeks not only to distinguish corruption in the private sector from co-occurrences such as competition, lobbying and the provision of gifts, but also to specify the threats and potential harm. The second part of the monograph is devoted to a detailed analysis of the main measures to address the problem of corruption in the private sector in Lithuania, including criminal law, labour law, civil law and private sector self-regulation.
