Nauji mokymai advokatams ir socialinių tarnybų darbuotojams apie tarptautinę šeimos teisę

Lietuvos teisės institutas (LTI) kartu su užsienio partneriais pradėjo įgyvendinti dvejų metų trukmės projektą „Keturios ES mokymų sesijos skirtingų šalių teisininkams bei socialinių tarnybų darbuotojams šeimos teisės reguliavimo klausimais“ („C.L.A.S.S.4EU“), kurio metu bus parengti ir projekte dalyvaujančių šalių teisininkams bei socialinių tarnybų darbuotojams organizuojami mokymai žinioms apie tarptautinę šeimos teisę gilinti.

Europos Sąjungos (ES) iš dalies finansuojamame projekte dalyvauja ne tik LTI mokslininkai, bet ir projekto partneriai iš Italijos, Vengrijos ir Portugalijos.

Įgyvendinant „C.L.A.S.S.4EU“ bus parengtos ir suorganizuotos keturios bandomosios ir keturios pagrindinės mokymų sesijos šeimos teisės reguliavimo klausimais projekte dalyvaujančių šalių teisininkams ir socialinių tarnybų darbuotojams.

Kartu su mokymų kursais bus paruošta ir mokymų medžiaga, kuri tiesiogiai aiškins, kaip turėtų būti interpretuojamas ir pritaikomas Reglamentas „Briuselis IIa“, Išlaikymo reglamentas ir kiti tarptautiniai dokumentai sudėtingose šeimos teisės bylose. Mokymų medžiaga bus pateikta kaip garso ir vaizdo dokumentai, taip pat bus parengti mokymų medžiagą pristatantys tekstai. Be to, bus pristatytas naujas lyginamasis teisinės terminologijos žodynėlis. Per mokymus Italijoje (Verona), Portugalijoje (Braga), Vengrijoje (Budapeštas) bei Lietuvoje (Vilnius) su paruošta medžiaga bus supažindinta apie 280 teisininkų ir socialinių paslaugų darbuotojų.

Projektas „C.L.A.S.S.4EU“ yra LTI jau įgyvendinto projekto, skirto teisėjų mokymams, tęsinys. Pastaruosius dvejus metus LTI dalyvavo Europos Sąjungos finansuojamame projekte ir rengė teisėjų mokymus apie tinkamą Reglamento „Briuselis IIa“ taikymą. Reglamentas „Briuselis IIa“ šiuo metu yra pagrindinis instrumentas ES valstybių narių teismo procesuose sprendžiant tarptautinius su santuoka arba su tėvų pareigomis susijusius atvejus. Šis Reglamentas yra teisinis pagrindas reguliuoti teisinę tvarką šeimos teisės srityje Europos Sąjungoje. Vis dėlto, nors vienodas Reglamento taikymas ir jo aiškinimas yra būtina Europos Sąjungos Teisingumo Teismo saugoma sąlyga, jo nepakanka suvienodinti ES valstybių narių teismų nuosprendžius šeimos teisės srityje. Tokia situacija gerai atskleidžia ne tik teisininkų bei socialinių tarnybų darbuotojų teisinių mokymų aktualumą, bet ir poreikį susisteminti ir įvertinti ES valstybių teismų praktiką.

Šis projektas organizuojamas atsižvelgiant į tai, jog migracija ir tarptautinio pobūdžio šeimos ES tampa įprastiniu reiškiniu. Projektu „C.L.A.S.S.4EU“ siekiama apsaugoti vaikų ir kitų pažeidžiamų asmenų teises kritinėse situacijose, susijusiose su santuoka ir tėvų pareigomis, gilinant teisininkų ir socialinių darbuotojų žinias tiek apie Reglamentą „Briuselis IIa“, Išlaikymo reglamentą, tiek apie kitus ES reglamentus bei tarptautines konvencijas dėl šeimos teisės.

In conjunction with foreign partners, the Law Institute of Lithuania (hereinafter – LIL) has begun implementation of a two-year project “4 EU Training Sessions on Family Law Regulations for Cross-border Lawyers and Social Services” (“C.L.A.S.S.4EU”) during which courses will be prepared and organised for lawyers and social workers of the participating countries to enhance their knowledge of international family law.

LIL researchers are being joined in the project, which is being partially funded by the European Union (EU), by project partners from Italy, Hungary and Portugal.

As part of the “C.L.A.S.S.4EU” project, four trial and four key training sessions on family law regulations will be prepared and organised for lawyers and social workers of the participating countries.

Along with the courses, training materials will be prepared which will directly explain how the Brussels IIa Regulation, the Maintenance Regulation, and other international documents in complex family law cases should be interpreted and applied. The training material will be presented as audio and video documentation, and texts introducing the training material will also be prepared. In addition, a new comparative glossary of legal terminology will be presented. During the training sessions in Italy (Verona), Portugal (Braga), Hungary (Budapest) and Lithuania (Vilnius), some 280 lawyers and social workers will be introduced to the prepared material.

The “C.L.A.S.S.4EU” project is the continuation of a project for training judges already carried out by the LIL. Over the past two years, the LIL participated in an EU-funded project and held training for judges on proper application of the Brussels IIa Regulation. The Brussels IIa Regulation is currently the main instrument in EU Member State court proceedings for cross-border cases involving marriage or parental responsibility. This Regulation is the legal basis for regulating the legal procedures in the field of family law in the European Union. However, even though consistent application of the Regulation and its interpretation are a prerequisite secured by the Court of Justice of the European Union, it is not sufficient to make the judgments of EU Member State courts in the area of family law uniform. This situation clearly demonstrates not only the relevance of legal training for lawyers and social workers, but also the need to systematise and evaluate the practice of EU courts.

This project is organised in light of the fact that migration and international families in the EU are becoming a regular occurrence. The goal of the “C.L.A.S.S.4EU” project is to protect the rights of children and other vulnerable persons in critical situations related to marriage and parental responsibility by enhancing the knowledge of lawyers and social workers both about the Brussels IIa Regulation and the Maintenance Regulation, and about other EU regulations and international conventions on family law.
