Žmogaus teisių dienos proga – apie nekaltumo prezumpciją

Minint Tarptautinę žmogaus teisių dieną, Seimo Žmogaus teisių komiteto surengtoje konferencijoje „Asmens apsauga – valstybės pareigos ir atsakomybė“ Lietuvos teisės instituto (LTI) mokslininkas dr. Justas Namavičius skaitė pranešimą apie nekaltumo prezumpciją.

Dr. J. Namavičius savo pranešime atskleidė nekaltumo prezumpcijos principo sampratą, taip pat aptarė, kiek jis, be teisminės valdžios, sieja ir kitas valstybės institucijas – vykdomosios valdžios bei įstatymų leidybos.

Mokslininkas taip pat apibrėžė šio principo taikymo ribas, aptarė kai kurias galiojančių įstatymų nuostatas bei aktualius Lietuvos Konstitucinio Teismo nutarimus. Pranešimo pabaigoje nagrinėti klausimai, kaip nekaltumo prezumpcijos principas siejasi su alternatyviomis konflikto sprendimo formomis – atleidimu nuo baudžiamosios atsakomybės, bylos nutraukimu esant procesinėms kliūtims, taip pat principo santykis su policinėmis nusikaltimo prevencijos priemonėmis.

Nekaltumo prezumpcijos klausimus konferencijoje nagrinėjo ir Lietuvos Respublikos Konstitucinio Teismo teisėja dr. Danutė Jočienė, kuri aptarė nekaltumo prezumpcijos principo aiškinimą Europos Žmogaus Teisių Teismo ir Konstitucinio Teismo praktikoje.

Kiti pranešėjai gvildeno privatumo apsaugos klausimus, taip pat viešumo poveikį šeimai ir vaikams, konfidencialumo ribas, lygių galimybių pasiekimus Lietuvoje bei kitas aktualias temas.

In commemoration of International Human Rights Day, Law Institute of Lithuania (LIL) research fellow Dr Justas Namavičius delivered a speech about the presumption of innocence at “Personal Protection: The Duties and Responsibilities of the State”, a conference held by the Seimas Committee on Human Rights.

In his speech, Dr Namavičius disclosed the concept of the principle of the presumption of innocence, and also discussed to what extent it, without judicial authority, is linked to other state institutions – the executive branch and the legislature.

The researcher also defined the scope of application of this principle and discussed certain provisions of existing laws as well as relevant rulings of the Constitutional Court of Lithuania. At the end of the speech, questions were examined on how the principle of the presumption of innocence relates to alternative forms of conflict resolution such as exemption from criminal liability and termination of proceedings in the event of procedural obstacles, as well as the relationship of the principle to police crime prevention measures.

The presumption of innocence was also touched upon at the conference by Justice of the Constitutional Court of the Republic of Lithuania Dr Danutė Jočienė, who discussed interpretation of the principle of the presumption of innocence in the case law of the European Court of Human Rights and the Constitutional Court.

Other speakers examined privacy issues as well as the impact of publicity on the family and children, the limits of confidentiality, equal opportunity achievements in Lithuania, and other relevant topics.
