New scientific opinions in the “Legal E-Topics” publication

 

“Legal E-Topics” – is an online publication that distributes social development works prepared by researchers of the Law Institute of the Lithuanian Centre for Social Sciences and submitted to state and municipal institutions.

In the new issue, you will find Dr Dovilė Pūraitė-Andrikienė opinion delivered in a constitutional justice case Nr. 4/2019 on whether Paragraph 2 of Article 7 of the Constitution of the Republic of Lithuania and the constitutional principle of a state under the rule of law are not in conflict with March 1 Resolution no. 149 “On the Implementation of the Law on Science and Studies of the Republic of Lithuania (as amended on 9 August 2017), sub-items 1.2.1, 1.2.2.

Dr Simonas Nikartas and Dr Skirmantas Bikelis delivered an opinion in a constitutional justice case Nr. 14-A/2019, whether Paragraph 2 of Article 31 of the Constitution of the Republic of Lithuania did not contradict Paragraph 1 (wording of 19 March 2015) of Article 75 of the Criminal Code of the Republic of Lithuania, in so far as the law of the court has been restricted, taking into account all the circumstances of the case, to postpone the implementation of a custodial sentence, imposed on a person convicted of a very serious crime. The researchers gave another opinion on two proposals of the members of the Seimas of the Republic of Lithuania to tighten criminal liability for cruel treatment of animals. 

Dr Eglė Kavoliūnaitė-Ragauskienė formed an opinion in a constitutional justice case Nr. 13/2019. The researcher answered whether Item 3 of Paragraph 3 (wording of 26 June 2014) of the Law on Local Self-Government of the Republic of Lithuania, Paragraph 1 of Article 5, Paragraph 2 of Article 5, Paragraph 1 of Article 19, Article 20 (wording of 26 June 2014 with subsequent amendments) Paragraph 2, does not contradict Article 119 of the Constitution of the Republic of Lithuania. Also, after the Chief Official Ethics Commission applied to the Institute, Dr Eglė Kavoliūnaitė-Ragauskienė answered whether AB Ignitis group, as the parent company, and its group companies can participate in the process of drafting legal acts relevant to the companies of this group.

Dr Skirmantas Bikelis expressed an opinion on draft laws No. XIVP-96 and XIVP-95, submitted by the group of members of the Seimas of the Republic of Lithuania, that proposes to decriminalize the illegal possession of small quantities of narcotic drugs and psychotropic substances without the aim of distributing them.

Dr Petras Ragauskas submitted an opinion on amendment No. XIIIP-5042 of the Law on the Prevention of Corruption of the Republic of Lithuania No. IX-904. Opinion delivered on the draft law no. XIIIP-5042 to the Committee on National Security and Defense of the Seimas of the Republic of Lithuania appointed for consideration as the main committee, based on the request of the chairman of this committee on 16 December 2020.
