TOWARDS IMPROVEMENTS IN LEGISLATIVE PROCESS: EVALUATION OF LEGAL ACTS, IT’S TYPES AND PRACTICE (94)

This article deals with the evaluation of legislation as part of legislative circle. It aims to present the development of the evaluation of legislation, to disclose its concept and to identify the differences between ex ante and ex post evaluations. Furthermore, the article discusses the OECD recommendations in this area and assesses the advantages and shortcomings of Lithuanian regulatory framework.

DIFFERENT KINDS OF FINANCING BASED ON RECEIVABLES AND OPPORTUNITIES TO APPLY THEM IN LITHUANIA (59)

Šiame straipsnyje vertinamos Lietuvos teisės normų suteikiamos galimybės įmonėms gauti pigesnį ir prieinamesnį finansavimą piniginių reikalavimų pagrindu. Visų pirma nagrinėjamos faktoringą reguliuojančios teisės normos. Galima teigti, kad faktoringas Lietuvoje tinkamai reguliuojamas. Toliau vertinamos galimybės naudotis kitais tokio finansavimo būdais: finansavimu neinformuojant skolininko, finansavimu įkeičiant piniginius reikalavimus bei sekiuritizacijos mechanizmu. Daroma išvada, kad pagal dabartines teisės normas šie finansavimo būdai yra arba sunkiai prieinami, arba iš viso neprieinami. Galiausiai, iškeliama mintis, kad galbūt šiuos finansavimo būdus reikėtų reguliuoti ne po vieną, bet kartu.

LEGAL EVALUATION OF THE POSSIBILITY TO CHARGE THE ACCUSED TO COVER THE COSTS OF INVESTIGATION OF CRIME (71)

In addition to the imposed penalty an accused person must compensate the damage that arise from the investigation of his crime. Currently the accused must pay the losses directly connected with the particular crime. Meanwhile, some of the states require the criminal to cover not only the direct losses, but as well a part of the expenses associated with the investigation of his crime. Such proposals are being raised in Lithuania as well. The article analyses the possibility to introduce the mentioned measures in Lithuania.

DĖL KAI KURIŲ PRIESAGOS -INIS, -Ė BŪDVARDŽIŲ TEISĖS KALBOJE: TEIKTINA IR NETEIKTINA VARTOSENA (79)

Šioje apžvalgoje pirmiausia siekiama aptarti vieną iš gausesnių žodžių darybos klaidų grupių – tai išvestiniai būdvardžiai su priesaga -inis, -ė, kurių pamatiniai žodžiai yra abstraktūs veiksmažodiniai daiktavardžiai, turintys priesagas -imas, -ymas, -umas, -inys ir kt. Ne vieno sudėtinio teisės termino dėmuo yra toks nesisteminės, lietuvių kalbai neįprastos darybos būdvardis, patekęs net į įstatymų, kodeksų ir jų komentarų bei vadovėlių kalbą. Šie priesagos -inis, -ė vediniai yra neteiktinos darybos, tad turėtų būti keičiami taisyklingais atitikmenimis. Dažniausiai tokius dirbtinius ir todėl vengtinus darinius atstoja bendrinei kalbai įprastas daiktavardžio kilmininkas, kitais kartais, atsižvelgiant į termino vartojimo kontekstą, siūloma vartoti dalyvį ar kitą taisyklingą konstrukciją. Taigi apžvalgoje pristatoma esama padėtis – kokie terminai ir kiti dažnesni pasakymai vartojami teisės kalboje su minėtais neteiktinais būdvardžiais, šio kalbos reiškinio kalbininkų vertinimai ir siūlymai.

ON PRECONDITIONS FOR NON-OPERATION OF LEGAL REGULATION OF LOBBYING IN LITHUANIA (73)

Aim of the article is to evaluate why the Law of the Republic of Lithuania on Lobbying Activities and the provisions related to it are not implemented in practice. For this purpose the article assesses the officially declared aims of the regulation of lobbying activities, discusses the establishment of clients of lobbying activities and subjects holding the status of a lobbyist, as well analyses the ways and reasons for failure to apply the method of “whip and honey cake” inherent to the regulation of social relations, shortly describes the actual volume of the official lobbying determined by the legal regulation in effect.

FREEDOM OF SPEECH: PROBLEMS AND PARADOXES (57)

Freedom of opinions, believes and views analyzed in this article is a very important aspect of freedom of speech or self-expression. Fundamental principals of the implementation of such the freedom and the grouds of its restrictions are stated in the international documents on human rights and in national Constitution.

HUMAN EQUALITY: THE PROBLEMS AND THE PARADOXES (55)

The Constitutional principle of human equality express their formal equality and the prohibition to discrimate equal people or, contrarily, to accord them priviledges. However, formal human equality does not disprove their actual ineguality and it even helps to occur for such. There exist no thorough research of human equality theoretical and practical problems but only fragmentary attempts in lithuanian legal literature.
