HAGUE PEACE CONFERENCES AND THEIR IMPACT ON LAW OF WAR ON LAND (63)

The article deals with the classical questions of Hague Law of War, namely but not limited: classic combatant concept, Marten‘s clause and classic understanding of occupatio bellica. The content of these concepts is revealed by looking at travaux preparatoire of the Hague Peace Conferences (1899 and 1907) as well as at normative texts and their subsequent interpretation in legal writings.

AMICUS CURIAE IN FOREIGN LEGAL SYSTEMS AND INTERNATIONAL LAW: ANALYSIS OF (DIS)QUALIFYING FEATURES AND RELATED LEGAL PHENOMENA (72)

This article deals with some aspects of amicus curiae, phenomenon which is almost unknown in Lithuanian positive law and its jurisprudence. The article presents the spread of this legal phenomenon (at this stage mostly indirectly by giving examples on its various aspects) and its basic elements in legal systems of different foreign countries as well as in international law.

CONCLUSION OF INTERNATIONAL TREATIES AND OTHER INTERNATIONAL AGREEMENTS UNDER THE LAW OF LITHUANIA AND OTHER STATES: SEARCHING FOR THE BEST PRACTICE (89)

The article analyses the definition of international treaties and other international agreements (so called international administrative agreements / executive agreements/ inter-agency agreements and soft law agreements) under the law of the Republic of Lithuania and numerous other states and compares differences in the practice of their conclusion.

THE RELATIONSHIP BETWEEN BALANCING OF HUMAN RIGHTS AND OTHER CONSTITUTIONAL VALUES AND „PREFERRED FREEDOMS“ DOCTRINE (70)

This article analyses the results of applying the two doctrines interpreting constitutional provisions, i. e. balancing of constitutional values in the Republic of Lithuania and preferred freedoms doctrine which was applied by the US Supreme Court during 1940–1950. In quest of similarities between these doctrines the context of interpreting cases relating to freedom of information/   speech freedom it is analysed.

THE PRIORITY OF PUBLIC INTEREST OVER LEGITIMATE EXPECTATIONS IN CONSTITUTIONAL JURISPRUDENCE (87)

Author of the paper presents the result of the analysis of the jurisprudence of the Lithuanian Constitutional Court of the last years concerning the cases related to protection of public interest. Firstly, the most frequently used by this Court attributes are discussed in it which can help to identify interest as a public interest. Secondary, the arguments are analyzed which provide priority to public interest in the situations where the private and public interest clash, also in such cases when public interest meets the legitimate expectations of persons.

REAL ESTATE LEASE TRANSACTIONS IN THE FRAMEWORK OF THE LITHUANIAN MERGER CONTROL SYSTEM (76)

Straipsnyje nagrinėjama Konkurencijos tarybos praktika taikant koncentracijų kontrolės teisės normas konkrečiai sandorių rūšiai – komercinės paskirties nekilnojamojo turto nuomos sandoriams, vertinamos šios praktikos susiformavimo priežastys ir pateikiami siūlymai dėl iškeltų teisės aiškinimo ir taikymo problemų sprendimo. Pagrindinis analizuojamas klausimas – tinkamas komercinės paskirties nekilnojamojo turto nuomos sandorio kvalifikavimas koncentracijų kontrolės tikslais. Straipsnyje parodoma, kad atsakymas į šį klausimą neišvengiamai susijęs su kompleksine konkretaus sandorio ir jo sudarymo bei vykdymo aplinkybių visumos analize. Taigi siekiant visapusiškai atskleisti nagrinėjamą problematiką, nagrinėjami esminiai koncentracijos ir kontrolės įgijimo sampratos elementai, kontrolės įgijimo būdo – nekilnojamojo turto nuomos – ypatumai, kontrolės objekto – nekilnojamojo turto kaip ūkio subjekto ar jo dalies – kokybinės ir kiekybinės savybės, taip pat įgyjamo turto sąsajumas su padėtimi atitinkamoje rinkoje ir tokios rinkos apibrėžimo svarba bei pajamų priskyrimas nekilnojamajam turtui.
