Der vorliegende Aufsatz beschäftigt sich mit dem Verhältnis zwischen den jeweils im Recht der Europäischen Union, Konvention zum Schutz der Menschenrechte und Grundfrei heiten (EMRK) sowie im nationalen Recht angelegten Grundrechten aus strafrechtlicher Sicht.

THE EUROPEAN UNION ECONOMIC CONSTITUTION AS THE ADDITIONAL DIMENSION OF THE CONSTITUTION OF THE REPUBLIC OF LITHUANIA: CONTOURS OF THE RESEARCH (84)

Straipsnyje, remiantis, be kita ko, ordoliberalų mokyklos atstovų darbais, analizuojama „ekonominės konstitucijos“ sąvoka ir su tuo susiję klausimai: kodėl valstybės (ar politinės bendruomenės) ūkio būvį nusakantys principai turėtų būti konstitucijos dalimi, kaip jie turėtų būti apibrėžiami, kad būtų užtikrintas optimalus siekiamų tikslų įgyvendinimas, koks galėtų būti ekonominės konstitucijos turinys. Šios analizės pagrindu tiriamas ekonominės Lietuvos Respublikos Konstitucijos turinys: valstybės principinę ūkio būvio orientaciją nusakantys principai, pamatinis asmens ūkinės veiklos laisvės, kaip šią orientaciją užtikrinančios teisinės garantijos, turinys, privataus asmens, politinių institucijų ir Konstitucinio Teismo galių pusiausvyra šioje srityje. Analogiškai tiriami pagrindiniai Europos Sąjungos ekonominės konstitucijos bruožai: principinė ūkio būvio orientacija, pagrindinės teisinės tokios orientacijos užtikrinimo garantijos, vertikalus ir horizontalus viešosios valdžios galių padalijimas šioje srityje. Pirmiau atlikto tyrimo pagrindu vertinamas ES ekonominės konstitucijos poveikis Lietuvos Respublikos Konstitucijai, analizuojamos jų tarpusavio sąsajos.

This article aims at examining the mandate provided to the SRB in the context of the Short-selling judgment, and in particular, at analysing whether the granting of discretionary implementing powers to this agency complies with Article 114 TFEU and whether those powers are well framed by conditions and criteria that no scope is le{ for abuse of the delegation.

IMPACT OF AGING ON LABOUR LAW: INTERNATIONAL AND EUROPEAN UNION APPROACH (86)

Lithuania like other European countries is experiencing demographic process of aging. The situation when the older population is growing and outnumbers the younger population strongly influences, among other things, the labour market. The necessity to overcome the negative effects posed by the aging process, particularly by ensuring wide and active participation of older people in the labour market, is determined not only at the national but also at the European and international levels. Therefore the aim of this article is the formation and reflection of the legal discourse of aging in international and European legal sources, identifying the legal measures, used to eliminate or at least mitigate the threats of the aging population to the stability of the labour market.

THE LITHUANIAN GUARANTEE FUND: DEMAND, LEGAL REGULATION AND PRACTICE (68)

The authors of the article analyses the demand and the legal regulation of the Lithuanian Guarantee Fund and seeks to determine its practical activity. The authors focus on how Lithuanian act of Guarantee Fund correspond to the Conventions of the International Labour Organization and to the directives of European Union. Also in the paper authors analyses the statistics of Guarantee Fund practice and seeks to determine the importance of the Lithuanian Guarantee Fund in the depression.

The article analyzes the preconditions and conception of corruption in labor relations, the elements of corruption and their peculiarities in labor relations. In the end, different institutes of labor law are evaluated from the perspective of corruption risk.
