Lietuvos teisės instituto (LTI) kartu su partneriais vykdomas projektas „Teisinės pagalbos kokybės gerinimas: bendrieji standartai skirtingoms šalims“ turi padėti Europos Sąjungos (ES) teisės aktų įgyvendinimui. Tokia mintis buvo išsakyta Frankfurte vykusioje tarptautinėje konferencijoje.
Šioje ekspertų konferencijoje iš Lietuvos partnerių dalyvavo LTI mokslininkai, Valstybės garantuojamos teisinės pagalbos tarnybos ir Lietuvos advokatūros atstovai. Įvairius klausimus renginyje taip pat svarstė ir kiti projekto partneriai: atstovai iš Frankfurto prie Maino J. W. Goethe’s universiteto bei Nyderlandų teisinės pagalbos valdybos. Į konferenciją buvo pakviesti tarptautiniu lygiu pripažinti mokslininkai, taip pat čia dalyvavo Europos Komisijos, Vokietijos ir Lietuvos teisingumo ministerijų darbuotojai, Vokietijos teismų ir advokatūros atstovai.
Konferencijos dalyviai itin dėmesingai aptarinėjo Škotijoje visų valstybės finansuojamą teisinę pagalbą teikiančių advokatų veiklos kokybės užtikrinimui taikomą tarpusavio peržiūros (angl. peer review) modelį, kurį detaliai pristatė prof. Alanas Patersonas, IT technologijų panaudojimo galimybes, sudarant sąlygas sulaikytam asmeniui nedelsiant pasikonsultuoti su advokatu, kurias pristatė dr. Vicky Kemp iš Jungtinės Karalystės.
Renginyje dalyvavę ekspertai labai palankiai įvertino projekto tyrimo rezultatus ir projektų partnerių rengiamus kokybės standartus bei atlikto ekspertų vertinimo tyrimo rezultatus. Buvo akcentuota, kad projekto metu sukurti instrumentai turėtų svariai prisidėti prie veiksmingo Europos Sąjungos teisės aktų, susijusių su teisinės pagalbos kokybės užtikrinimu, įgyvendinimo.
Projekto „Teisinės pagalbos kokybės gerinimas: bendrieji standartai skirtingoms šalims“ tikslas yra sukurti minimalius advokatų veiklos ir teisinės pagalbos standartus, tinkamus taikyti visose ES valstybėse, ir pateikti šių standartų laikymosi kontrolės metodiką. Turint tikslą pagerinti teisinių paslaugų kokybę, kuriami bendri standartai dėl teisinės pagalbos teikimo ir kokybės užtikrinimo, didinant teisinės pagalbos politikų, administratorių ir paslaugų teikėjų gebėjimus, siekiant užtikrinti aukštos kokybės teisinę pagalbą.
Vykdant projektą „Teisinės pagalbos kokybės gerinimas: bendrieji standartai skirtingoms šalims“ atliekamas išsamus vertinimas ir palyginami trys skirtingi teisinės pagalbos organizavimo modeliai šalyse partnerėse. Visų pirma vertinami teisine pagalba suinteresuotų šalių (paramos gavėjų, administratorių, teikėjų, kriminalinės justicijos sistemos dalyvių) poreikiai ir lūkesčiai. Taip pat bus pasiremta geriausia ES valstybių narių praktika. Tai leis sukurti visapusišką rekomendacijų paketą politikos formuotojams, kaip pagerinti teisinės pagalbos paslaugų kokybę.
Įgyvendinant projektą taip pat bus sukurtos mokymų programos teisinės pagalbos politikos formuotojams, teisinės pagalbos administratoriams ir teisinės pagalbos teikėjams. Lietuvoje, Vokietijoje ir Nyderlanduose bus organizuojami mokymai.

The project entitled “Enhancement of legal aid quality: general standards for different systems”, implemented by the Law Institute of Lithuania (hereinafter – LIL) and partners, is aimed to contribute to the implementation of European Union (EU) legislation. This idea has been expressed at the international conference in Frankfurt.
This conference of experts has been attended by the following Lithuanian partners: LIL researchers, representatives from the State-Guaranteed Legal Aid Service and the Lithuanian Bar Association. Various issues have also been discussed by other project partners: representatives from Goethe-Universität Frankfurt am Main and the Dutch Legal Aid Board. World-renowned researchers have been invited to the conference which has also been attended by the employees of the European Commission, the German and Lithuanian Ministries of Justice, the representatives of German courts and bar association.
Conference participants particularly thoroughly discussed the peer review model applied to quality assurance of all lawyers who provide state-financed legal aid in Scotland, which had been presented in detail by Prof. Alan Paterson, as well as the possibilities of use of IT technologies to create conditions for the detained person to immediately consult a lawyer, which had been presented by Dr. Vicky Kemp from the United Kingdom.
The experts who attended the event very favourably evaluated the research results of the project, the quality standards prepared by project partners as well as the research results of expert review. It was emphasised that the instruments developed during the project should significantly contribute to the efficient implementation of European Union legislation relating to legal aid quality assurance.
The aim of the project “Enhancement of legal aid quality: general standards for different systems” is to create minimum standards for lawyers’ activities and legal aid, which could be applied in all EU Member States, and to present the methodology for the control of compliance with these standards. In order to improve the quality of legal services, common standards regarding the provision of legal aid and quality assurance are developed, while enhancing the capacities of legal aid politicians, administrators and service providers in order to ensure high quality legal aid.
The project “Enhancement of legal aid quality: general standards for different systems” includes comprehensive evaluation and comparison of three different models of legal aid organisation in partner countries. The needs and expectations of the parties interested in legal aid (beneficiaries, administrators, providers, criminal justice system participants) are initially evaluated. The best practices of EU Member States will also be used. This will enable the creation of comprehensive package of recommendations for policy-makers how to improve the quality of legal aid services.
The project will also result in the creation of training programmes for legal aid policy-makers, legal aid administrators and legal aid providers. Trainings will be organised in Lithuania, Germany and the Netherlands.
